Terms of Service

These terms govern your use of the NOGADA mobile application ("the App"). By creating an account or signing in, you agree to these terms. If you don't agree, don't use the App.

1. The App

NOGADA helps small construction businesses log work, manage crew, generate quotes and invoices, and track project profitability. It is provided as-is, without warranty of any kind.

2. Your account

You must be at least 18 years old and able to enter contracts.
You're responsible for keeping your sign-in credentials safe.
You're responsible for the accuracy of the data you enter (business details, ABN, invoice amounts, payments received, etc.).
One person per account. Crew members get their own accounts linked to a business owner.

3. Your data

You own the data you enter. We store it on your behalf.
See our Privacy Policy for what we collect and how we store it.
You can export or delete your data at any time (see Privacy Policy → Your choices).

4. Acceptable use

Don't use NOGADA to:

Send invoices or quotes you have no legal right to issue.
Misrepresent your business identity, ABN, or tax status.
Upload material you don't have the right to share.
Attempt to access another business's data, reverse-engineer the App, or interfere with its operation.

We can suspend or terminate your account if you do.

5. Money matters

NOGADA generates invoices and quotes for you to send to your clients. You are responsible for collecting payment, paying tax (GST), and meeting all legal/accounting obligations for your business.
The App's profit/cost/margin calculations are estimates based on the data you enter. They are not financial, tax, or accounting advice. Consult a registered accountant for tax decisions.
The App is currently free to use. We may introduce paid plans in the future; if we do, existing users will be notified in advance and given a choice (continue on free tier, upgrade, or export and leave).

6. Service availability

We try to keep the App available, but can't guarantee uptime.
We may pause, change, or discontinue features. We'll give reasonable notice for material changes.
We may release updates that change the App's behaviour. Continuing to use the App after an update means you accept the changes.

7. Third-party services

NOGADA uses:

Google Firebase for authentication, data storage, and file storage.
Google Calendar (only when you grant access) to read crew assignment event titles.
Anthropic Claude API to extract text from receipts you upload.

These services have their own terms and privacy policies. Their availability is outside our control.

8. No warranty, limited liability

The App is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, or consequential damages, lost profits, lost data, or business interruption arising out of your use of the App. Total liability for any claim shall not exceed the amount you paid us for the App in the 12 months before the claim (which, on the free tier, is zero).

9. Changes to these terms

We may update these terms. Material changes will be announced in the App at next sign-in. Continued use after a change means you accept the new terms.

10. Governing law

These terms are governed by the laws of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of the courts of Victoria.
